Texas Power of Attorney Forms enables an individual to choose a trusting person, called an “agent” or “attorney-in-fact,” to make financial, medical, parental/guardianship (minor child), and vehicle-related decisions on their behalf. There are also special forms, referred to as “Durable,” that allow the document to remain effective even if the principal (person being represented) should become incapacitated. Use of the Durable forms ensures the principal that their health and finances will be managed properly regardless of their mental capacity.
Not only are children in general big targets of identity theft but children who are in foster care are even bigger targets. This is because they are most likely moved around quite frequently and their SSN is being shared with multiple people and agencies. Foster children are even more victims of identity theft within their own family and other relatives. Young people in foster care who are victims of this crime are usually left alone to struggle and figure out how to fix their newly formed bad credit.[21]
Life insurance serves as a source to pay death taxes and expenses, fund business buy-sell agreements, and fund retirement plans. If sufficient insurance proceeds are available and the policies are properly structured, any income tax on the deemed dispositions of assets following the death of an individual can be paid without resorting to the sale of assets. Proceeds from life insurance that are received by the beneficiaries upon the death of the insured are generally income tax-free.

You have to go to court and get a guardianship and/or conversatorship as is warranted by the situation. If he was injured in the military, you may be eligible for military legal services to help you obtain the forms needed to get this done. If not, you will likely have to obtain legal assistance via an attorney in the private sector or seek legal aid in your home state.
Standardized forms are available for various kinds of powers of attorney, and many organizations provide them for their clients, customers, patients, employees, or members. However, the grantor should exercise caution when using a standardized POA form obtained from a source other than a lawyer because there is considerable variation in approved formats among the states.[8] In some jurisdictions statutory power of attorney forms are available.[18]
Keep the original forms in a safe place. In Texas, you do not have to submit the power of attorney forms to any agency for it to be valid. You just have to keep an original or copies with you at all times in case you may need it in the future. You might want to keep the original document in a safe at home or in a safe deposit box at a bank. If a lawyer drafts a power of attorney for you, they will automatically keep the original documents on file in their office.
Most living wills have the option of adding a health care agent to carry out the patient’s intended wishes. This is helpful in the event that there is a gray area where maybe the agent selected feels there is a good chance for survival and will opt against a decision made in the living will. Otherwise, the Principal can choose to neglect this portion of the document and have doctors and medical staff specifically adhere to what is written in the living will.
The type of information taken during a breach can vary widely depending on what personal info the company has stored, and what the perpetrator is able to access. Sometimes, the types of info stolen can also depend on the purpose of the breach, which could vary from making a political statement to a hacker simply “showing off”. Perpetrators that are committing breaches for financial gain generally target personal information that can be resold on the dark web and be used for identity fraud, focusing on info like full names, email addresses, passwords, Social Security number, date of birth and driver’s license number to name a few.
Living wills are often used with a document called a durable power of attorney (DPOA) for healthcare. In some states, in fact, the two documents are combined into one. A DPOA appoints someone to carry out the wishes about end-of-life treatment that are written down in a living will or medical directive. The person named is called the “agent,” “healthcare proxy,” or “attorney-in-fact” of the person who makes the DPOA.
You can also write a letter of instruction to leave step-by-step instructions as well as spell out your personal wishes for things like your funeral or what to do with your digital assets like social media accounts. If you're married, each spouse should create a separate will, with plans for the surviving spouse. Finally, make sure that all the concerned individuals have copies of these documents.
You must sign and notarize the original power of attorney document, and certify several copies. Banks and other businesses will not allow your agent to act on your behalf unless they receive a certified copy of the power of attorney. Attorneys are unnecessary to execute a power of attorney. However, it may be wise to consult one for advice about the powers being granted, to provide counsel on your candidate agent, and to make sure your document meets all legal requirements.
Before our firm drafts any power of attorney, we will sit down and learn more about your specific circumstances. In fact, after careful consultation, people sometimes determine that they do not wish to grant this type of authority to anyone. If you do decide to create a power of attorney, we will determine whether it becomes effective immediately, or only at the time of your incapacitation. Only after learning these things, can we draft the most appropriate power of attorney for your situation.
Sign your living will according to your state's rules. Many states require at least 1 witness to watch you sign the form. The witness must be someone who is not your relative, healthcare provider, or legal agent. Some states will not accept your living will as valid without the right witnesses. Check with your lawyer if you are not sure about the state laws for living wills.

With a living will, you can make decisions to have or not have treatments to prolong your life. You are able to do this before you need them. You can choose to stop, limit, or not have certain medical treatments. Think about how you want to feel and how long you want to be able to live. For example, you may be willing to have some pain with a treatment if it allows you to live longer. You may want to refuse or stop treatments that prolong life, but cause you constant or severe pain. Some of your treatment choices include:

A variation of identity theft which has recently become more common is synthetic identity theft, in which identities are completely or partially fabricated.[14] The most common technique involves combining a real social security number with a name and birthdate other than the ones associated with the number. Synthetic identity theft is more difficult to track as it doesn't show on either person's credit report directly but may appear as an entirely new file in the credit bureau or as a subfile on one of the victim's credit reports. Synthetic identity theft primarily harms the creditors who unwittingly grant the fraudsters credit. Individual victims can be affected if their names become confused with the synthetic identities, or if negative information in their subfiles impacts their credit ratings.[15]

The Texas general power of attorney form grants broad powers to an individual selected to handle business affairs, representation, and all real personal and property actions on another’s behalf. The form grants the exact same powers to the agent as the Durable form except that this document does not remain in effect if the principal should become incapacitated and unable to think for themselves. The Office of the Public Guardian provides an online process for registering a lasting power of attorney.[20] It is a bureaucratic minefield, full of traps for the unwary;[citation needed] and the end result can be disappointing, as many financial institutions do not trust lasting powers, viewing the attorney simply as a potential fraudster, and in practice tend to be highly uncooperative.

If you've changed jobs over the years, it's quite likely that you have several different 401(k) retirement plans still open with past employers or maybe even several different IRA accounts. You may want to consider consolidating these accounts into one individual IRA. Consolidating of accounts allows for better investment choices, lower costs, a larger selection of investments, less paperwork, and easier management.

A growing area of concern involves medical identity theft, which gives thieves the ability to access prescription drugs and even expensive medical treatments using someone else’s identity. When successful, medical identity theft frequently results in erroneous entries being put into the victim’s medical records, which in turn may even lead to inappropriate and potentially life-threatening decisions by medical staff.
In March 2014, after it was learned two passengers with stolen passports were on board Malaysia Airlines Flight 370 which went missing on 8 March 2014, it came to light that Interpol maintains a database of 40 million lost and stolen travel documents from 157 countries which it makes available to governments and the public, including airlines and hotels. The Stolen and Lost Travel Documents (SLTD) database however is little used. Big News Network which is based in the UAE, observed that Interpol Secretary General Ronald K. Noble told a forum in Abu Dhabi the previous month this was the case. "The bad news is that, despite being incredibly cost effective and deployable to virtually anywhere in the world, only a handful of countries are systematically using SLTD to screen travelers. The result is a major gap in our global security apparatus that is left vulnerable to exploitation by criminals and terrorists," Noble is quoted as saying.[42]
Jamin was amazing. We are a construction company that was served with a lawsuit. Jamin was quick to respond, went above and beyond what we expected during the consultation. Jamin also informed us that we had free legal counsel through our insurance, no other lawyer we spoke with mentioned that even once. If you want a lawyer that will look out for you and your pocket book, Jamin is your man. We will be recommending him to all family friends in the near future.See more
