One of the major identity theft categories is tax identity theft. The most common method is to use a person's authentic name, address, and Social Security Number to file a tax return with false information, and have the resulting refund direct-deposited into a bank account controlled by the thief. The thief in this case can also try to get a job and then their employer will report the income of the real taxpayer, this then results in the taxpayer getting in trouble with the IRS.[23]
If the attorney-in-fact is being paid to act on behalf of the principal, a contract for payment may be separate from the document granting power of attorney. If that separate contract is in writing, as a separate document it may be kept private between the principal and agent even when the power of attorney is presented to others for the purposes of carrying out the agent's duties.

In some jurisdictions, a durable power of attorney can also be a "health care power of attorney." This particular affidavit gives the attorney-in-fact the authority to make health-care decisions for the grantor, up to and including terminating care and life support. The grantor can typically modify or restrict the powers of the agent to make end-of-life decisions.[14] In many jurisdictions a health care power of attorney is also referred to as a "health care proxy" and, as such, the two terms are sometimes used interchangeably.[8]

CPR and DNR: Healthcare providers use CPR to try to restart your heart if it stops beating. Sometimes electric shock is used. Consider when and how long you want CPR if you have a terminal disease or are in a long-term coma. If you do not want CPR, you can add a DNR (do not resuscitate) order to your living will. A copy of the DNR order must also go in your medical records.


Let's focus on a revocable living trust for the purpose of estate transfer. Like a will, a trust will require you to transfer property after death to loved ones. It is called a living trust because it is created while the property owner, or trustor, is alive. It is revocable, as it may be changed during the life of the trustor. The trustor maintains ownership of the property held by the trust while the trustor is alive.

If your chosen agent is not present when you sign your power of attorney forms, you will need to notify them that you have signed a power of attorney granting them permission to take certain actions on your behalf. This gives the agent notice of their ability to make decisions for you in specific situations.

Most people can create this simple document - along with the other typical estate planning documents - without the high legal fees by using a quality software application that accounts for their state's laws. The Office of the Public Guardian provides an online process for registering a lasting power of attorney.[20] It is a bureaucratic minefield, full of traps for the unwary;[citation needed] and the end result can be disappointing, as many financial institutions do not trust lasting powers, viewing the attorney simply as a potential fraudster, and in practice tend to be highly uncooperative.
The Texas Living Will known also as an Advance Health Care Directive is to allow a person, often known as the `Principal`, to legally choose their medical treatment should they become incapacitated to such a degree that they are no longer rational to make these choices. A Texas living will requires a notary or two witnesses. The document is created in accordance with statutes §§166.031 to 166.053 and is legally binding for any periods of time stipulated by the principal
A power of attorney terminates if the principal becomes incapacitated, unless it is a special kind of power of attorney known as a “durable power of attorney.” A durable power of attorney remains effective even if a person becomes incapacitated. However, there are certain exceptions specified in Florida law when a durable power of attorney may not be used for an incapacitated principal. A durable power of attorney must contain special wording that provides the power survives the incapacity of the principal. Most powers of attorney granted today are durable.
Seek legal counsel in the creation of a will. A will can be effective in an estate transfer and other legal proceedings after death, but there are drawbacks of which you should be aware. Your estate will become part of the public record, for example, and anything left by a will must go through probate court. Also, probate attorneys can be expensive and cannot be avoided, except in California and Wisconsin.

If you’re helping someone with their estate planning (or doing your own), don’t overlook a living will. It can give invaluable guidance to family members and healthcare professionals if a person can’t express his or her wishes. Without a document expressing those wishes, family members and doctors are left to guess what a seriously ill person would prefer in terms of treatment. They may end up in painful disputes, which occasionally make it all the way to a courtroom.

There are several types of identity theft that are used to gather information, one of the most common types occurs when consumers make online purchases.[35] A study was conducted with 190 people to determine the relationship between the constructs of fear of financial losses and reputational damages.[35] The conclusions of this study revealed that identity theft was a positive correlation with reputable damages.[35] The relationship between perceived risk and online purchase intention were negative.[35] The significance of this study reveals that online companies are more aware of the potential harm that can be done to their consumers, therefore they are searching for ways to reduce the perceived risk of consumers and not lose out on business.

Identity theft occurs when someone steals your personal information—such as your Social Security number, bank account number, and credit card information. Identity theft is committed in many different ways. Some identity thieves sift through trash bins looking for bank account and credit card statements. Other more high-tech methods involve accessing corporate databases to steal lists of customer information. Once they have the information they are looking for, identity thieves can ruin a person's credit rating and the standing of other personal information.
The agent will always want to add after his or her signature that the document is being signed “as agent for” the principal. If the agent signs only his or her own name, the agent may be held personally responsible for whatever was signed. As long as the signature clearly indicates that the document is being signed in a representative capacity and not personally, the agent is protected. Though lengthy, it is, therefore, best to sign as follows:

While you may think that you've covered all your bases, it may be a good idea to consult with a professional on a full investment and insurance plan. As you get older, your needs may change, such as figuring out if you need long-term care insurance and protecting your estate from a large tax bill or lengthy court processes. Professionals will also be up on changes in legislation and income or estate tax laws, which could impact your bequests.
Standardized forms are available for various kinds of powers of attorney, and many organizations provide them for their clients, customers, patients, employees, or members. However, the grantor should exercise caution when using a standardized POA form obtained from a source other than a lawyer because there is considerable variation in approved formats among the states.[8] In some jurisdictions statutory power of attorney forms are available.[18]
For a power of attorney to become a legally enforceable document, at a minimum it must be signed and dated by the principal.[7] Some jurisdictions also require that a power of attorney be witnessed, notarized, or both.[8] Even when not required, having the document reviewed and signed (and often stamped) by a notary public may increase the likelihood of withstanding a legal challenge.[9]

Although a power of attorney grants the agent powers to perform acts in the absence of the grantor, the POA cannot grant powers to the agent that conflict with rules and regulations governing people and companies that the agent deals with. For example, if a bank has regulations that require the grantor to be physically present in the bank to perform certain actions, the POA cannot grant the agent power to perform those actions in the absence of the grantor.

Sweden has had relatively few problems with identity theft. This is because only Swedish identity documents have been accepted for identity verification. Stolen documents are traceable by banks and some other institutions. The banks have the duty to check the identity of people withdrawing money or getting loans. If a bank gives money to someone using an identity document reported as stolen, the bank must take the loss. Since 2008, any EU passport is valid in Sweden for identity check, and Swedish passports are valid all over the EU. This makes it harder to detect stolen documents, but still banks in Sweden must ensure that stolen documents are not accepted.
A power of attorney must be signed by the principal and by two witnesses to the principal’s signature, and a notary must acknowledge the principal’s signature for the power of attorney to be properly executed and valid under Florida law. There are exceptions for military powers of attorney and for powers of attorney created under the laws of another state.
